TERMS AND CONDITIONS OF PURCHASE FROM HUSH PUPPIES EUROPE is the trading name of Wolverine Europe Limited WEBSITE
1. PUTTING OUR ARRANGEMENT IN PLACE
1.1 In this Agreement, we are HUSH PUPPIES EUROPE is the trading name of Wolverine Europe Limited (the Supplier) of Kings Place, 90 York Way, London, N1 9AG and you are the person detailed on the Order Form (the Consumer).
1.2 This agreement is made on the date the Supplier deducts payment from the Consumer's credit card, the details of which are provided on the Order Form. However please note that we do not accept orders from outside of the UK.
1.3 This agreement includes all correspondence from the Supplier to the Consumer and the descriptions of the goods as provided by the Supplier on the Hush Puppies website or otherwise.
2. MAKING YOUR CHOICE AND ORDERING
2.1 Peruse our web site and select the products.
2.2 Complete the Order Form in full and follow the instructions detailed on the web site.
3. WHAT HAPPENS NEXT
3.1 The products are subject to availability. If the products are not available or the Consumers offer to purchase the goods is refused you will be notified as soon as possible and any payment made in respect of the unavailable goods will be refunded.
3.2 Should the Consumer not receive the chosen products within 10 days of the Supplier confirming their availability, the Consumer should contact the Supplier. The Consumer will then be given the choice of:
3.2.1 cancelling the order whereupon the Supplier will retrieve the goods and then refund the price paid back to the credit card nominated originally on the order form and if the products are subsequently received the Consumer will return them;
3.2.2 requesting that a replacement order be despatched (subject to availability) on the basis that the Consumer will return one set of the products if they receive both sets; or
3.2.3 waiting a further agreed time period after which if the chosen products have still not been received then options 3.2.1 or 3.2.2 will again become available.
4. IF YOU ARE NOT SATISFIED
4.1. The Consumer has the right to cancel the contract at any time up to the end of 14 working days after it receives the products (see below). A working day is any day other than weekends and bank or other public holidays.
4.2 To exercise the right of cancellation, the Consumer must give written notice to the Supplier by hand or post, fax or email, at the address, fax number or email address shown below, giving details of the products ordered and (where appropriate) their delivery.
4.3 If the Consumer exercises its right of cancellation after the goods have been delivered, the Consumer should return the products to the Supplier using the label enclosed with the products, whereupon a refund, minus a handling charge of £3.50, will be made provided that the product(s) is returned in the same condition as it was received by the Consumer.
4.4 The return of faulty or damaged goods should be made in accordance with the arrangements detailed in the information pack, which accompanied the products.
4.5 If the Consumer does not return the goods as required the Supplier may charge the Consumer a sum not exceeding the direct costs of recovering the goods.
5. BASIS OF SALE
5.1 The terms of the Supplier's agreement with the Consumer, shall govern the contract to the exclusion of any other terms and conditions.
5.2 No variation to this Agreement shall be binding unless agreed in writing by the Supplier.
5.3 Any typographical clerical or other error or omission in any website, sales literature, price list, acceptance of offer or other document or information issued by the Supplier is subject to amendment by the Supplier where reasonable in all of the circumstances to do so.
5.4 The Consumer is responsible for ensuring the accuracy of the details provided on the Order Form.
5.5 The quantity and description of the chosen products shall be those set out in the Order Form unless subsequently agreed otherwise.
6. PRICE OF THE GOODS
6.1 The price of the Goods shall be the price quoted by the Supplier on the Hush Puppies web site next to the illustration/description of the products, unless agreed otherwise by the Supplier in writing. The price is inclusive of any value added tax payable in the UK and postage and packing within the UK.
6.2 Products can only be despatched to a UK postal address and the Supplier may cancel any order which is not to a valid UK postal address.
7. RISK AND PROPERTY
7.1 Risk of damage to or loss of the chosen products shall be passed onto the Consumer upon delivery of them.
7.2 Notwithstanding delivery and the passing of risk in the Consumer's chosen products or any other provision of this Agreement, property in the Consumer's chosen products shall not pass to the Consumer until the Supplier receives cleared funds payment in full for the price of the Consumer's chosen products.
8. WARRANTIES
8.1 The Supplier warrants that the Consumer will be entitled to the benefit of any warranties or guarantees provided with the products. This does not affect the Consumer's statutory rights.
8.2 The Consumer warrants that the information entered onto the Order Form is true.
8.3 Where the Supplier sells to the Consumer under a Consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) the Consumer's statutory rights are not affected by this Agreement.
9. FORCE MAJEURE
The Supplier shall not be liable to the Consumer or be deemed to be in breach of this Agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any causes beyond the Suppliers reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond the Suppliers reasonable control:-
9.1 Act of God explosion flood tempest fire or accident;
9.2 War or threat of war sabotage insurrection civil disturbance or requisition;
9.3 Acts restriction regulation bylaw prohibitions or measures of any kind on the part of any governmental parliamentary or local authority;
9.4 Import or export regulations or embargoes;
9.5 strikes lock-outs or other industrial actions or trade disputes (whether involving employees of us or of a third party);
9.6 power failure or breakdown in machinery.
10. GENERAL
10.1 If any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.
10.2 This contract is made in England as an Electronic written contract in English language, and all dates in this contract and documents provided by the Supplier shall be in accordance with the Gregorian calendar.
10.3 As the Supplier does not accept orders from outside of the UK in the event of any dispute the laws of England shall apply and the courts of England and Wales shall have exclusive jurisdiction.
10.4 Where the Supplier, Consumer or any third party translates this contract and/or documents provided by the Supplier into any other language (including into any audible sound or touch sensitive language for the visually or hearing impaired) personally or using any language translation service. (human or electronic) the electronic written United Kingdom English language versions of the contract and/or the documents provided by the Supplier, shall prevail.
11. CONFIDENTIALITY AND DATA PROTECTION
11.1 The Supplier shall take all reasonable precautions to keep the detail of your order and payment secure but unless the Supplier is negligent, it will not be liable for unauthorised access to information supplied by the Consumer. The Supplier will process the Consumers information in accordance with its Privacy Policy{link}.
12. WHOLE AGREEMENT
The terms and conditions set out in this Agreement and any documents referred to in them represents the entire Agreement between the parties.
